ImageClaim is a technology platform, not a law firm. Nothing on this platform, including any letter template, scan result, educational resource, or communication from ImageClaim, constitutes legal advice. You should consult a qualified solicitor or attorney before taking any legal action.

1. Overview

ImageClaim provides a technology-based service to help photographers and visual content creators identify potential instances of unauthorised use of their images and to generate template correspondence relating to copyright enforcement. This Disclaimer applies to all use of the Service and must be read alongside our Terms of Service, Acceptable Use Policy, and Privacy Policy.

By using the Service, you acknowledge that you have read and understood this Disclaimer and agree that ImageClaim is not providing legal services of any kind.

2. ImageClaim Is Not a Law Firm

ImageClaim is a software company, not a law firm or legal services provider. ImageClaim is not authorised or regulated by the Solicitors Regulation Authority (SRA), the Bar Standards Board, the Florida Bar, or any other legal regulatory body in any jurisdiction.

ImageClaim does not employ solicitors, barristers, attorneys, or any other legal professionals in a capacity that would give rise to a solicitor-client or attorney-client relationship with users of the Service.

The Service is a self-service technology tool. Any guidance, educational content, template letters, or suggested actions provided through the Service are provided purely as informational resources to assist you in exercising your own independent judgement. They are not, and should not be taken as, legal advice tailored to your specific circumstances.

2.1 Regulatory Compliance

Nothing in the Service is intended to constitute the provision of reserved legal activities within the meaning of the Legal Services Act 2007 (England and Wales), the provision of legal services under applicable US state bar rules, or the provision of legal services under any other applicable law. If any element of the Service could be construed as constituting the provision of legal services in your jurisdiction, you agree not to rely on it as such, and to seek independent qualified legal advice instead.

3. No Attorney-Client Relationship

Your use of the Service does not create, and is not intended to create, any attorney-client relationship, solicitor-client relationship, or any other professional relationship between you and ImageClaim or any person associated with ImageClaim.

  • No communication between you and ImageClaim (whether through the platform, by email, by support chat, or otherwise) constitutes legal advice or creates an attorney-client relationship;
  • ImageClaim does not act as your legal representative in any dispute, proceeding, or negotiation;
  • ImageClaim has no duty of confidentiality toward you in respect of any information you provide through the Service, beyond what is stated in our Privacy Policy;
  • ImageClaim is not bound by any professional obligations or duties that would apply to a solicitor or attorney acting on your behalf.

If you require legal representation in a copyright dispute, you must instruct a qualified solicitor or attorney independently. ImageClaim can provide introductory referrals to third-party legal professionals (see Section 7), but such referrals do not constitute engagement of legal services by ImageClaim on your behalf.

4. Template Letters Are Not Legal Advice

4.1 Nature of Templates

The cease and desist letter templates and DMCA takedown notice templates generated by the Service are standardised template documents. They are designed as a starting point for your own correspondence and are provided for informational and convenience purposes only.

Template letters generated by the Service:

  • Are not tailored to the specific legal circumstances of your case;
  • Do not constitute a legal opinion on whether an infringement has occurred;
  • Do not constitute advice on whether sending such a letter is appropriate or legally advisable in your circumstances;
  • May not be appropriate for use in all jurisdictions or in all factual scenarios;
  • Should not be sent without first reviewing the content and, where appropriate, seeking independent legal advice.

4.2 Your Responsibility

You are solely responsible for reviewing any letter generated by the Service before sending it, ensuring the factual accuracy of any statement made in it, and satisfying yourself that you have a genuine legal basis for any claim made. ImageClaim accepts no responsibility for any letter sent by you using templates generated by the Service.

4.3 False or Groundless Claims

Sending a cease and desist letter or DMCA notice without a genuine good-faith belief that infringement has occurred may expose you to civil liability under applicable law (including 17 U.S.C. § 512(f) in the United States). You should ensure that any legal notice you send is accurate and sent in good faith. See our Acceptable Use Policy for further guidance.

5. Results Are Not Guaranteed

ImageClaim makes no representation or warranty, express or implied, that:

  • Use of the Service will result in the removal of infringing content from any website or platform;
  • Cease and desist letters or DMCA notices generated using the Service will be effective, acknowledged, or complied with by any recipient;
  • Any legal claim pursued by you in connection with a Scan result will be successful;
  • The Service will identify all instances of unauthorised use of your images — Scans may not be exhaustive or complete;
  • The outcomes achieved by other ImageClaim users are replicable in your specific case.

Outcomes in copyright enforcement depend on many factors outside ImageClaim's control, including the laws of the relevant jurisdiction, the response of the alleged infringer, the nature and circumstances of the alleged infringement, and the decisions of third parties including platform operators and courts. ImageClaim cannot predict or guarantee any outcome.

5.1 Testimonials and Case Studies

Any testimonials, success statistics, or case study descriptions featured on the Service or associated marketing materials represent individual experiences and are not indicative of expected or typical results. Past outcomes are not a reliable guide to future outcomes. Individual results will vary.

6. Scan Accuracy Disclaimer

6.1 Technology Limitations

The image scanning feature of the Service uses third-party technology (including Google Vision API and TinEye) to identify potential matches between your uploaded images and images found on the web. These technologies have inherent limitations and cannot guarantee:

  • That all instances of your images online will be detected — the Service may not have access to all indexed web content;
  • That all Match results returned are genuine instances of copyright infringement rather than coincidental visual similarities, licensed uses, fair use, or fair dealing;
  • The accuracy, reliability, or completeness of Match data;
  • The continued availability of any third-party scanning service integrated with the platform.

6.2 Human Review Required

Every Match result must be reviewed by you before you take any action. A Match result is an indication of a potential match only — it is not a determination of copyright infringement. You must apply your own judgement to assess whether a Match represents a genuine infringement and whether any action is warranted.

6.3 No Liability for Scan Errors

ImageClaim is not liable for any loss or damage arising from reliance on Scan results, including any Match that is later determined to be erroneous, or any instance of infringement that the Service failed to detect.

7. Third-Party Legal Referrals

7.1 Nature of Referrals

ImageClaim may, from time to time, provide users with introductory information about, or referrals to, third-party solicitors, attorneys, and intellectual property law firms who specialise in copyright enforcement matters. Such referrals are provided as a convenience only.

7.2 Independence of Referred Professionals

Any solicitor, attorney, or law firm referred to you through the Service is an independent third party. They are not affiliated with, employed by, or acting as an agent of ImageClaim. Any engagement of legal services by you from a referred professional is a matter solely between you and that professional. ImageClaim:

  • Does not endorse, vouch for, or guarantee the quality, competence, or suitability of any referred professional;
  • Does not supervise, oversee, or take any responsibility for the services provided by referred professionals;
  • Is not party to any retainer, contract, or engagement between you and a referred professional;
  • May receive a referral fee or other compensation from referred professionals — this will be disclosed to you where required by applicable law.

7.3 Due Diligence

You are responsible for conducting your own due diligence before instructing any legal professional, including verifying their qualifications, regulatory status, experience, and fee arrangements. ImageClaim accepts no liability for any act, omission, or advice of any referred professional.

9. Jurisdictional Variation

Copyright law varies significantly between jurisdictions. The information and templates provided by the Service are prepared with reference to the law of England and Wales and the law of the United States (in particular, federal copyright law and the Digital Millennium Copyright Act). They may not be appropriate for, or legally compliant in, other jurisdictions.

In particular, ImageClaim does not warrant that:

  • The templates are suitable for use in your jurisdiction;
  • The legal concepts discussed in educational content apply in your country;
  • The fair use or fair dealing exceptions discussed correspond to the law in your jurisdiction;
  • The DMCA process is available or applicable outside the United States.

If you are located outside England and Wales or the United States, you should seek specific legal advice in your jurisdiction before taking any action based on information or templates from the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law, ImageClaim and its officers, employees, contractors, and agents shall not be liable for any loss or damage of any kind arising from or in connection with your use of the Service, including without limitation:

  • Any reliance on information, templates, scan results, or educational content provided by the Service;
  • Any legal action taken or not taken by you in connection with the Service;
  • Any outcome of any legal proceeding in which correspondence generated using the Service was used;
  • Any claim by a third party against you arising from your use of the Service;
  • Any failure or delay of any third-party service integrated with the platform;
  • Any loss of revenue, data, goodwill, or business opportunity arising in connection with the Service.

This limitation applies whether the claim arises in contract, tort (including negligence), misrepresentation, breach of statutory duty, or otherwise, and whether or not ImageClaim was advised of the possibility of such loss or damage.

Nothing in this Disclaimer excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

For the avoidance of doubt, this Disclaimer supplements (and does not replace) the limitation of liability provisions in our Terms of Service, which continue to apply.
